    1. Introduction

    These Terms of Service, together with the documents referred to herein, set out the rules for using www.smthspcl.com and purchasing products through this website.

    Please read these Terms and our Privacy Policy carefully before using the website. By placing an order, you confirm that you have read and accepted these Terms. The Terms apply to each order placed after acceptance.

    We may update these Terms from time to time. Changes will not affect orders already placed before the new version becomes effective. We recommend reviewing the Terms and Privacy Policy before each new order.

    The agreement for purchasing products through this website is referred to below as the Agreement.

    3. Using the Website

    By using www.smthspcl.com and placing orders through it, the Client agrees to:

    • use the website only for lawful purposes;

    • not provide unlawful content;

    • respect intellectual property rights and not copy content, photographs, or other materials from the website without permission;

    • not place false or fraudulent orders;

    • provide true and accurate email addresses, shipping addresses, and other contact details required to place an order.

    If the Client does not provide all required information, the order may not be processed.

    By placing an order, the Client confirms that they have full legal capacity to enter into binding contracts.

    To use www.smthspcl.com, the Client needs a working internet connection and an up-to-date web browser.

    4. Product Features and Availability

    The features of each product are described in the product description available on www.smthspcl.com.

    Product photos are for illustrative purposes only and may differ slightly from the actual product due to screen settings, lighting, or other technical factors.

    The products offered on the website may be delivered within Poland and abroad, depending on the delivery options available at checkout.

    5. Orders and Order Processing

    To place an order, the Client must complete the online purchase process, including:

    • adding products to the cart;

    • choosing the delivery method;

    • choosing the payment method;

    • confirming the order by clicking the final purchase button.

    Orders are placed through the www.smthspcl.com website.

    If the provided information is incomplete, we may contact the Client. If contact is not possible, we may cancel the order.

    Purchases may be made either as a registered user or as a guest.

    After placing an order, the Client will receive an automatic email confirming receipt of the order.

    After payment is completed, the Client will receive an automatic email confirming payment.

    If payment is not completed immediately, the Client may receive a payment reminder email 48 hours after placing the order. If payment is not received within 96 hours after placing the order, the order may be automatically cancelled.

    If the Client notices an error in the order, they should contact us immediately by email or through the contact details provided on the website.

    After payment confirmation, the order will move to processing status. Order processing and preparation for shipment usually takes between 1 and 7 business days.

    We reserve the right to refuse to fulfil an order in exceptional circumstances, for example if a product is found to be defective and no identical replacement is available in stock.

    Once the order has been prepared for shipment, the Client will receive an email with shipment details.

    The Agreement is concluded when the order is accepted for fulfilment and shipment confirmation is sent to the Client.

    Order data is stored in our system. Accounting documents confirming the Agreement are stored for the period required by applicable law.

    The Client may choose to save their data in the system to make future purchases easier. In that case, the Client creates an account by providing an email address and password.

    The Client’s password is not known to us. The Client is responsible for keeping login details confidential and protecting them from unauthorized access.

    6. Delivery

    We deliver the products according to the shipping method selected at checkout and the approximate delivery time indicated during the order process.

    For the purposes of these Terms, delivery is considered completed when the Client or a third party indicated by the Client, other than the carrier, physically receives the product.

    Before accepting the shipment, the Client should check whether the packaging has been damaged during transport.

    Available delivery methods may include:

    • InPost, including Parcel Lockers;

    • Poczta Polska;

    • other methods shown at checkout, if available.

    Saturday delivery may be available depending on the carrier and service selected.

    7. Failure to Collect Delivery

    If the Client fails to accept or collect the shipment, we may grant an additional period for collection.

    If the shipment is still not collected within that additional period, we may cancel the Agreement.

    In such case, any amounts paid under the Agreement will be refunded within 14 days, minus any direct shipping costs incurred by us due to the Client’s failure to collect the shipment. These costs may be deducted from the refund amount.

    8. Transfer of Risk and Ownership

    The risk related to the product passes to the Client upon delivery.

    Ownership of the product passes to the Client in accordance with applicable law and once full payment has been received, unless mandatory law provides otherwise.

    9. Prices and Payment

    All prices displayed on the website are stated in Polish złoty (PLN).

    Shipping costs are not included in the product price unless clearly stated and are added to the total order value at checkout.

    Prices may change at any time, but changes do not affect orders already placed.

    The Client may pay using the following payment methods:

    • Shopify Payments;

    • Przelewy24.

    The Client should complete payment within 4 business days.

    In exceptional cases, such as limited stock, payment may be required within a shorter period of 24 hours.

    A receipt or invoice may be issued where applicable.

    10. Right of Withdrawal and Returns

    10.1 Statutory Right of Withdrawal

    If the Client is a Consumer or a sole trader with consumer rights, they have the right to withdraw from the Agreement without giving any reason within 14 days from the day on which they or a third party indicated by them, other than the carrier, takes physical possession of the purchased product.

    If the order contains multiple products delivered separately, the 14-day period begins on the day the last product is received.

    To exercise the right of withdrawal, the Client must inform us by email at hello@smthspcl.com.

    The email should include the order number and a clear statement that the Client wishes to withdraw from the Agreement.

    The Client may also use the model withdrawal form available on our website, but this is not mandatory.

    The right of withdrawal does not apply to:

    • goods made to the Client’s specifications or clearly personalised;

    • sealed goods that are not suitable for return for health protection or hygiene reasons if the seal has been removed after delivery;

    • other products excluded from the right of withdrawal under applicable law.

    10.2 Effects of Withdrawal

    If the Client validly withdraws from the Agreement, we will refund all payments received from the Client, including the cost of standard delivery of the product to the Client, up to the amount of the least expensive ordinary delivery method offered by us.

    If the Client chose a delivery method more expensive than the least expensive ordinary delivery method, we will not refund the additional cost.

    We do not refund the return shipping cost paid by the Client for sending the product back to us. The cost of return shipping remains the Client’s responsibility.

    Refunds will be made without undue delay and no later than 14 days from the day we are informed of the withdrawal decision. We may withhold the refund until we have received the returned product or proof that it has been sent back, whichever occurs first.

    The Client must return the goods without undue delay and no later than 14 days from the day they informed us of their withdrawal. The deadline is met if the goods are sent back before the 14-day period expires.

    The Client is responsible for any decrease in the value of the goods resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

    Products purchased in the online store cannot be returned in physical boutiques, sent to parcel lockers directly as a refund request, or delivered personally to a return point unless this is part of the return process stated by us.

    • Liability for Diminished Value: The consumer is liable for any diminished value of the goods resulting from handling them in a manner other than what is necessary to establish the nature, characteristics, and functioning of the goods.

    • Condition of Returned Items: Items must be returned in their original condition, including all original packaging and non-removable tags. We reserve the right to reduce the refund amount if the items show signs of wear (e.g., perfume scents, makeup stains, or signs of washing).

    • Sealed Goods: For health protection or hygiene reasons, the right of withdrawal does not apply to sealed goods if the seal has been broken after delivery.

    11. Exchange Policy

    A purchased product may be exchanged within 14 days from the date of receipt.

    To be eligible for exchange, the item must:

    • show no signs of use;

    • be in the same condition as received;

    • have its tags attached;

    • be accompanied by proof of purchase.

    An exchange is possible only if the requested item, size, model, or colour is available in stock.

    The exchange process usually takes up to 14 days from the date we receive the returned item.

    The Client sends the item for exchange at their own cost and risk.

    The reshipment of the exchanged item is at our cost.

    The exchange policy is voluntary and does not limit the statutory right of withdrawal available to Consumers and sole traders with consumer rights.

    To request an exchange, the Client should use the form provided with the order or contact us by email.

    12. Complaints and Defective Products

    If a purchased product is defective, the Client who is a Consumer or a sole trader with consumer rights may file a complaint under applicable provisions of the Polish Civil Code and consumer law.

    If a defect is confirmed, the Client may be entitled to repair, replacement, price reduction, or refund, depending on the legal basis and the circumstances of the case.

    Claims should be submitted by email to hello@smthspcl.com, together with a description of the defect and proof of purchase, where available.

    We will review complaints within 14 days where required by applicable law.

    The Client may be asked to return the defective product to us for inspection.

    13. Defects

    A product is considered defective if it does not have the properties expected of it given its intended purpose, the description provided, the sample or model presented, or if it is incomplete.

    14. Personal Data and Privacy

    Any personal data provided by the Client will be processed in accordance with our Privacy Policy and applicable law, including Regulation (EU) 2016/679 of 27 April 2016 (GDPR).

    15. Promotions, Discount Codes, and Gifts

    We may run promotions and publish discount codes on www.smthspcl.com and through our social media channels.

    Promotions may not be combined unless explicitly stated otherwise.

    If the Client uses a newsletter discount code, it may not combine with other discount codes unless stated otherwise.

    We may add small gifts to orders from time to time.

    If the Client returns an order, small gifts that were added at our discretion do not need to be returned unless the gift was offered as part of a specific promotion requiring its return.

    16. Complaints and Out-of-Court Dispute Resolution

    If the Client wishes to submit a complaint related to the use of www.smthspcl.com, they may contact us by email at hello@smthspcl.com.

    If the sales contract was concluded online, the Client may also use the EU online dispute resolution platform, where applicable.

    17. Governing Law and Jurisdiction

    These Terms and any Agreement concluded through the website are governed by Polish law.

    Any disputes arising from the use of the website or the Agreement shall be submitted to the competent Polish courts.

    18. Final Provisions

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in force.

    These Terms are effective as of April 21, 2026.
